{"id":253,"date":"2025-11-04T18:28:34","date_gmt":"2025-11-04T18:28:34","guid":{"rendered":"https:\/\/catapulthr.co.uk\/?p=253"},"modified":"2025-11-04T18:28:36","modified_gmt":"2025-11-04T18:28:36","slug":"are-you-ready-for-the-new-worker-protection-act","status":"publish","type":"post","link":"https:\/\/catapulthr.co.uk\/en_gb\/are-you-ready-for-the-new-worker-protection-act\/","title":{"rendered":"Are You Ready for the New Worker Protection Act?"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><strong>What Every SME Needs to Know Before It\u2019s Too Late<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From October 2024, the <strong>Worker Protection<\/strong> (<strong>Amendment of Equality Act<\/strong>) Act 2023 introduced new responsibilities for UK employers \u2013 and if you run a small business or start-up, this change affects you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In simple terms, the law now <strong>requires employers<\/strong> <strong>to take proactive steps to prevent sexual harassment <\/strong>in the workplace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is no longer enough to react after something happens \u2013 you must be able to show that you\u2019ve taken <strong>reasonable preventative measures<\/strong> to protect your team.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What Does \u201cTaking All Reasonable Steps\u201d Mean?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For SMEs, this might sound vague \u2013 but in practice, it means having clear evidence that you\u2019re building a safe and respectful culture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">A <strong>clear anti-harassment policy<\/strong> that\u2019s accessible and regularly reviewed.<\/li>\n\n\n\n<li class=\"\"><strong>Training<\/strong> for all staff and managers so everyone understands what\u2019s acceptable and how to report concerns.<\/li>\n\n\n\n<li class=\"\"><strong>Risk assessments<\/strong> to identify potential hotspots or vulnerabilities.<\/li>\n\n\n\n<li class=\"\"><strong>Prompt, consistent action<\/strong> if an incident occurs.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If you can demonstrate that you\u2019ve done these things, you\u2019ll be far better protected if a claim ever arises \u2013 and more importantly, your employees will feel safer and more supported.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Why This Matters for SMEs<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Larger organisations usually have in-house HR teams, legal budgets, and detailed policies.&nbsp; But smaller employers often assume:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u201cWe\u2019re a small team, that sort of thing wouldn\u2019t happen here.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unfortunately, tribunals tell a different story.&nbsp; Even one inappropriate comment, ignored complaint, or untrained manager can lead to reputational damage, loss of trust, and costly claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recent data from the UK Employment Tribunal shows that the average award for sex discrimination claims in 2023\/24 was \u00a353, 403 (MF Mac, 2024).&nbsp; Separate estimates suggest that the average cost of a sexual harassment tribunal case \u2013 including compensation and associated expenses can range from \u00a327,000 to \u00a345,000, and is often far higher once legal fees and management time are added (Culture Shift, 2024).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the new Worker Protection (Amendment of Equality Act) Act 2023, tribunals can now apply an additional 25% uplift in compensation if an employer is found not to have taken \u201call reasonable steps\u201d to prevent harassment (Bindmans LLP, 2024).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For SMEs, this means that prevention isn\u2019t just good practice \u2013 it\u2019s financial and reputational protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How to Get Prepared Now<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You don\u2019t need to overhaul your entire HR setup \u2013 just start with the essentials:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"\"><strong>Review your policies<\/strong>.\u00a0 Make sure your harassment, grievance, and conduct policies are up to date and compliant.<\/li>\n\n\n\n<li class=\"\"><strong>Deliver training<\/strong>.\u00a0 Even a short session for employees and managers goes a long way.<\/li>\n\n\n\n<li class=\"\"><strong>Complete a harassment risk assessment<\/strong>.\u00a0 Identify where inappropriate behaviour might occur \u2013 and take steps to reduce the risk.<\/li>\n\n\n\n<li class=\"\"><strong>Create a speak-up culture<\/strong>.\u00a0 Make it clear that everyone one has a voice and that issues will be handled fairly and confidentially.<br><br><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How Catapult HR Can Help<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At Catapult HR Services, I\u2019ve created a Sexual Harassment Resource Pack specifically designed for SMEs.&nbsp;
